이 사건으로 당시 최순희에게 체포 영장이 떨어져 도피 생활을 했다. 이후 1994년 1월 10일 검찰에 자진 출두한 조희성 님을 살인 혐의로 구속 수사하면서 최순희 사건을 재수사했으나 혐의를 찾지 못했다. 검사는 공소장을 변경해 헌금 사기죄로 기소했고, 판사는 유죄를 판단 징역 2년 6월을 선고했다.
조희성님이 복역중에 검사가 이 최순희 사건을 조희성님이 최순희에게 지시하여 발생한 사건으로 조작하여 재기소했고, 1심 재판에서는 헌금 하지도 않은 사람들의 헌금을 모두 인정하면서 헌금 사기죄로 추가적인 징역 7년형에 그들이 마구 써낸 액수에 대한 배상 명령을 함께 선고 했다. 그러나 항소심에서는 징역 4년형에 그들의 헌금을 인정하지 않았기에 그들의 배상 신청을 모두 각하하였다.
최순희 사건이란 1994년 1월 10일, 역곡 본부제단에서 예배를 마친 조희성님을 태운 승용차가 구제단을 향해 길 건너 역곡시장을 지나갈 때, 건장한 남성들이 차를 막고 있는 광경을 지나가던 최순희가 목격을 하였던 것.
당시에 최순희는 제단 출석을 하지 않은지 꽤 오래된 사람인데, 조희성 님이 탄 차를 막는 이들을 목격하고 제단에 전화를 걸어 "탁명환이 보낸 깡패새끼들이 주님을 납치하려고 하니 빨리 오라"하였고, 건장한 남자들의 멱살을 잡고 몸싸움을 하였던 것.
불과 5분도 안되어 제단으로 부터 청년들이 현장에 뛰어 왔는데, 최순희가 남자 두명을 붙잡고 씨름을 하고 있었던 것. 삽시간에 제단에서 달려온 청년들로 둘러 싸였고, 최순희는 제단으로 끌고가야 된다고 하면서 남자 두명을 움켜잡고 갈때, 한 사람은 도망가고 한 사람만 제단 로비까지 데려왔던 것.
조희성님은 제단에 전화를 걸어서 그 사람이 누구인지 알려고 하지 말고 무조건 보내라고 지시를 했으나, 최순희는 몸싸움 중에 생긴 치료비라도 받아야 된다고 하면서 신분증 제시하라며 따귀를 때리기도 했던 것.
이때는 이미 부천 경찰서에서 경찰관이 제단에 도착해 있었고, 부천경찰서장과 형사과장이 도착하자 북적 거리는 로비에서 총무과 사무실로 이동하였음. 그 자리에서 그가 서울지검 강력부 형사 오oo 경장임을 밝힘. 형사들 입장에서 보면 불법 연행 시도 중에 승리제단 출석도 하지 않던 옛 신도 최순희가 끼어들어 발생한 해프닝이었던 것임.
이 해프닝을 검사하고 언론이 보도한 바에 따르면, 영생교도들이 공무집행 중인 경찰관을 감금해 폭행했다고 대대적으로 보도했고, 조희성 님이 지시를 해서 경찰을 폭행하고 공무집행을 방해한 것으로 사건을 조작하여 수차례에 걸쳐 기소하며 언론 플레이에 먹잇감을 던져주었던 것이다.
